Welcome to Retail Community. These Terms of Use ("Terms") govern your access to and use of the Retail Community website (retailcommunity.com.au), our online messaging groups (including WhatsApp communities), our mailing lists, event listings, directories and related services.
By accessing our website, subscribing to our communications, submitting information or joining our WhatsApp communities, you agree to be bound by these Terms.
1. About Retail Community
The Retail Community platform and community groups are operated by Retail Community Pty Ltd, an Australian company based in New South Wales ("Retail Community", "we", "us", or "our").
2. Community Membership & WhatsApp Groups
- Application & Eligibility: Access to our WhatsApp groups is generally intended for retail executives, brand operators, solution providers and professionals actively connected to the Australian retail industry.
- Administrator Discretion: Membership of any Retail Community WhatsApp group is not guaranteed. Retail Community reserves the right, at its sole discretion and subject to applicable Australian law, to:
- Approve, decline or defer membership applications;
- Moderate, edit or delete messages and media;
- Restrict access to specific groups or threads;
- Suspend or remove any member at any time without prior warning;
- Refuse future admission to any individual or organisation.
- Conduct: All members must comply with our Community Guidelines. Serious or repeated violations, including unsolicited sales pitches or harassment, will result in immediate removal.
3. Communications, Marketing & Consent
- Subscribed Communications: When you sign up, you consent to receiving communications from Retail Community in accordance with your registration choices. These communications may include community announcements, industry news, event invitations, surveys, advertising and promotional messages regarding our commercial partners and sponsors.
- Direct Communications by Retail Community: Retail Community may send sponsored or partner content directly to our subscribers.
- No General List Sharing: We do not sell, rent or provide our general mailing list or subscriber contact details to third-party sponsors for their independent marketing.
- Unsubscribing: You may unsubscribe from marketing emails at any time using the "unsubscribe" link included in every broadcast email. Unsubscribing from email communications does not automatically remove you from WhatsApp communities (which you may exit directly within WhatsApp at any time).
4. Events & Functions
- Event Terms: Retail Community organises dinners, roundtables, networking events and conferences. Individual events may be subject to supplementary Terms and Conditions, which take precedence over these general Terms where specified.
- Attendee Information: Depending on the specific event, registration may involve collection of attendee information, event photography and video recording.
- Sponsor Data Sharing at Events: Specified attendee information will only be shared with designated event sponsors where this has been clearly disclosed and agreed during that specific event’s registration process, in compliance with applicable law. General website membership does not grant blanket consent for third-party event marketing.
5. Directories (Service Providers & Events)
- Authority & Accuracy: By submitting an event, organisation or service provider listing to our directories, you confirm that you have authority to submit the information and that all submitted details are accurate to the best of your knowledge, lawful and current. You accept responsibility for errors and omissions in information you provide, subject to applicable law, and agree to these Terms of Use.
- Licence to Publish: You retain ownership of submitted material and grant Retail Community Pty Ltd a non-exclusive licence to publish, display, reproduce, format, edit for presentation and promote it through our website, newsletters, social media and community communications as reasonably necessary for the relevant activities. You warrant that you hold the necessary rights to provide the material.
- Moderation & Removal: Retail Community may review, edit, correct, reject, suspend or remove listings at its discretion, subject to applicable law. Appearance in our directory does not constitute an endorsement by Retail Community.
- Administrative Contacts: Contact information provided strictly for internal directory administration is stored privately and will not be published publicly without consent. We may contact listing administrators regarding directory management, updates, or relevant community, advertising, sponsorship and commercial opportunities, subject to applicable law.
6. Intellectual Property
All content created by Retail Community—including our website design, branding, logos, trademarks, text and original graphics—is the intellectual property of Retail Community Pty Ltd or its licensors. You retain ownership of materials you submit, subject to the limited licence granted to us above to operate and promote community activities.
7. Limitation of Liability & Disclaimers
- Australian Consumer Law Carve-Out: Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by Schedule 2 of the Competition and Consumer Act 2010 (Cth) or any other applicable Australian legislation that cannot lawfully be excluded.
- General Disclaimer: To the maximum extent permitted by law, our website, directory, groups and services are provided "as is" and "as available". We do not guarantee continuous, error-free operation or the accuracy of third-party user submissions.
- Third-Party Conduct: Retail Community is not responsible for the conduct of, advice given by, or commercial transactions entered into between community members or directory providers. Third-party websites and services are governed by their own terms; community discussions and recommendations are not professional advice.
8. Governing Law
These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. Any disputes arising under these Terms shall be subject to the jurisdiction of the courts of New South Wales, subject to mandatory applicable laws.
9. Changes to Terms
We may update these Terms periodically. Material changes will be published on this page with an updated revision date and communicated where appropriate. Changes do not apply retrospectively or override mandatory legal rights.
